FERPA Access Request
To whom it may concern:
Pursuant to the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g), I write to request access to and a copy of any and all records held by you or your office pertaining to me, including but not limited to emails between staff members and professional student staff members, text messages, reports, databases, letters, findings, records in any database maintained by your department, notes, memoranda, video, audio, and any other information pertaining to me maintained by:
- Advancement Office
- Computing and Information Services
- Dining Services
- Financial Aid Office
- Office of Residential Life
- Student Activities Office
- Transportation & ID Card Services
I am contacting you since you are the most senior and/or relevant department members locatable via online University resources. Please be aware that if you do not maintain the records requested, it is your responsibility to advise me of the correct official to whom the request should be addressed.
This request includes without limitation:- The timestamps, MAC address, and BSSIDs associated with all connections to Brown WiFi access points I have made.
- The records of every time I have swiped into a dining hall, as well as my specific dining choices and all written records pertaining to my dining history; and any e-mails, notes, memoranda, video, audio, or other documentary material maintained by the Dining Services.
- All financial information, commentary, and other written records pertaining to me; and any e-mails, notes, memoranda, video, audio, or other documentary material maintained by the Financial Aid Office.
- All commentary, accommodation information, housing assignment data and other administrative records pertaining to me stored by the Office of Residential Life; and any e-mails, notes, memoranda, video, audio, or other documentary material maintained by the Office of Residential Life.
- All documents held by the Student Activities Office, including without limitation any and all documentation pertaining to me stored with SAO, including but not limited to emails between staff members and professional student staff members, text messages, reports, databases, letters, findings, records in any database maintained by your department, and any and all other educational records held by your or your office; and any e-mails, notes, memoranda, video, audio, or other documentary material maintained by the Student Activities Office.
- All ID card photos and all transactions involving my ID card (including any stored logs of building entry, dining-related transactions, interactions with ValuePort machines, interactions with laundry machines, and interactions with vending machines.
As per 34 CFR Sec. 99.10(b), these records must be made available for my inspection within 45 days of this request.
As you fulfill this request, please be aware that FERPA prohibits the imposition of a fee to review documents (per 34 CFR Sec. 99.11(b)).
If you choose to redact any portion of any documents responsive to this request, please provide a written explanation for the redaction including a reference to the specific statutory exemption(s) upon which you rely. Also, please provide all segregable portions of otherwise exempt material.
Please be advised that a failure to provide access to these records within the statutory time limit will result in a complaint to the Office of Postsecondary Education. The penalty for an intentional failure to comply with FERPA's terms is the loss of all federal education funds, as per 20 U.S.C. Sec. 1232g(a)(2).
Please be advised that this FERPA request is my way of protesting [FILL].
My fellow students have valiantly attempted to be heard in other forums to no avail, so I am forced to resort to FERPA activism.
I shall consider withdrawing my FERPA request if and only if the Brown administration indicates publicly their intention to take concrete action to enact the will of the student body. Otherwise, I look forward to receiving a full response within 45 calendar days.
